Procopio’s renowned LaunchPad incubator is open for applications from startup entrepreneurs for its 2024 class. A program of Procopio Business Advisors, LLC (PBA) since 2012, this highly competitive program hosts emerging growth companies in Procopio’s Del Mar Heights offices, located in the heart of San Diego’s high-technology community. The companies’ entrepreneurs work side by side with Procopio attorneys as they begin the formation, protection of core technology, early funding and growth of their startups.
LaunchPad participants come from a wide variety of industries, including life sciences, med tech, and health care data. They receive a selection of complimentary corporate and intellectual property legal services along with office space and back-office business support.
Life Sciences CEO Connection Program Expanding Beyond Silicon Valley to San Diego and Orange County
Building on its tremendous success in Silicon Valley, Procopio is launching two additional Life Sciences CEO Connection peer-to-peer advisory programs in the San Diego and Orange County markets. Currently operating out of Procopio’s Palo Alto office and including 20 select early-stage life sciences CEOs, the Life Sciences CEO Connection program fosters meaningful professional connections and the support needed to address the unique challenges of leadership in the life sciences sector.
Procopio Partners Roger Rappoport, Noel Gillespie, Xiaofan “Frank” Yang and Paul Johnson will play supporting roles in the various programs, with Cardiff Advisory Managing Partner David Crean and Arrow Up Staging Chief Revenue Officer John Foley moderating various groups. Procopio’s Life Sciences CEO Connection program was developed in partnership with the CEO 360 Connect program founded by Crean and Foley.
Nominations are now being accepted in all three locations, and self-nominations are welcome. Accomplished Corporate Law Partner Assumes Leadership of Aviation and Marine Practice
Corporate Law Partner Jessica Lazur has assumed leadership of Procopio’s Aviation and Marine practice. Jessica has been an active attorney in the practice for several years, representing aircraft purchasers and sellers throughout transactions, including assisting buyers in obtaining California sales and use tax exemptions.
In addition to her aviation and marine practice, Jessica focuses on mergers and acquisitions and the representation of companies in their formation and organization, debt and equity financings, and general corporate matters. She represents public and private companies in a variety of buy-side and sell-side M&A transactions including statutory mergers, equity and asset purchases and sales, and cross-border acquisitions. She has represented clients in sales and acquisitions totaling billions of dollars.
Women’s Productive Health Innovator Fends off Generic ANDA Challenge
Congratulations to client Evofem Biosciences on successfully fending off a generic company’s challenge to key patents, ensuring continued patent protection for its hormone-free prescription birth control gel Phexxi® until 2033. Padagis Israel Pharmaceuticals Ltd. has withdrawn its Abbreviated New Drug Application (ANDA) for a generic version of FDA-approved Phexxi and has instead converted to a Paragraph III certification, meaning it won’t challenge Evofem’s patents and will ask the U.S. Food and Drug Administration to wait until all Phexxi patents expire before issuing final ANDA approval.
Procopio IP Litigation Partners Jeremy Edwards and Steve Maddox served as litigation counsel for Evofem’s patent litigation. IP Partner Xiaofan “Frank” Yang, PhD, performs the strategic planning and implementation of Evofem’s Orange Book patent portfolio covering Phexxi and counseled Evofem during its successful patent defense, and Partner Dennis Doucette provides corporate law services.
Adriana Ochoa and Adrian Martinez Named Latino Leaders of Influence
Procopio Partners Adriana Ochoa and Adrian Martinez have been named 2023 Latino Leaders of Influence by the San Diego Business Journal in partnership with the San Diego County Hispanic Chamber of Commerce.
Adriana Ochoa leads Procopio’s Health Care, Education and Government Team, and is Procopio’s first Latina Partner. Recognized by Best Lawyers in America, she represents public agencies and private clients with water, wastewater, transparency, governance, operational, litigation, and other legal issues, and serves as Chair of the California Association of Sanitation Agencies Attorneys Committee. Adriana is active in the San Diego La Raza Lawyers Association and the association’s Scholarship Fund, and has served on the Board of Directors of the latter and as its Chair, and is also active in Latinas in the Law. She serves as a Trustee for the Hans and Margaret Doe Charitable Trust, which provides water conservation education and scholarships, and on the Board of the San Diego Wellness Collaborative, which Improves health equity and population health in San Diego. Adriana provides pro bono assistance to the Center for Human Rights and Constitutional Law, assisting in the representation of detained immigrant minors and children separated from their families at the southern border.
Adrian Martinez represents domestic and foreign clients in litigation arising out of manifold business relationships, including partnerships and other fiduciary relationships. Recognized by Best Lawyers in America, Adrian is a frequent public speaker in the U.S. and Mexico, has taught as an adjunct professor for the California Western School of Law, and serves as a legal consultant for the Mexican Consulates in San Diego and Calexico. He is the creator of the Procopio International Litigation and Arbitration Retreat held September 28-29, 2023, which brought together in San Diego leading litigators from the U.S. and Mexico in a discussion of cross-border commercial legal disputes. Adrian was one of only two attorneys in the U.S. invited to write a chapter for the LEI International 2022 Guide to Enforcing Foreign Judgments, which included authors from Australia, Belgium, Brazil, Canada, Germany, Italy, Kenya, Singapore, Spain, and the United Kingdom.
Miku Mehta and Jeff Morton Named to 2023 IAM Strategy 300 List
Two Procopio IP Partners, Miku Mehta and Jeff Morton, have been named to the 2023 IAM Strategy 300 list, recognizing the value they bring to their clients in building strategic patent portfolios. IAM is a global publisher of data and analysis on intellectual property. It conducts research annually to identify leading individuals in the development and implementation of IP portfolio strategies. The research process includes face-to-face and telephone interviews, as well as email exchanges, with senior members of the global IP community.
Miku leads Procopio's Intellectual Property team and its Asia Pacific practice. He advises clients in the U.S. and Asia on intellectual property, patent prosecution and counseling, as well as trademarks and copyrights. His practice focuses on the preparation and prosecution of patent applications, due diligence projects, including preparation of opinions in the areas of patentability, validity, infringement and product clearance, and patent licensing. Miku has extensive experience in technology including computer software and hardware, networks, internet-related applications, environmental technologies, optics, mechanical engineering, business processes and medical devices, as well as registration and enewal of trademarks and counseling on export control matters.
Jeff leads Procopio's Life Sciences practice and co-leads its Licensing and Technology Transactions practice. He provides strategic intellectual property advice, including patent prosecution, and related transactional support for emerging and mature companies in a wide variety of industries, with a particular focus on life sciences and medical technologies. A PhD immunologist, he has extensive patent experience in technologies including genomics, immunology, and gene editing technologies, and advises on complex freedom-to-operate life sciences issues. Jeff also maintains an active trademark practice and provides cross-border legal advice with Canadian clients, being admitted in both the U.S. and Canada.
Meet Erica Spence, the newest member of our growing Life Sciences practice! Erica holds a Doctor of Pharmacy degree and worked for many years in the retail pharmacy industry. She first joined Procopio as a 2021 summer intern after her first year at California Western School of Law, and later became a law clerk assisting the firm’s patent prosecution attorneys in drafting patent claims and responding to U.S. Patent and Trademark Office (USPTO) non-final actions. She is also a registered patent agent, meaning she is licensed to practice before the USPTO. While at Cal Western, Erica was a Justice Anthony Kennedy Scholar, served as an associate writer and a law review editor, was a judicial extern, and worked at the school’s pro-bono trademark clinic. Erica also holds a BS in Biological Science: Molecular Biology and Biotechnology from California State University, Fullerton.

She assists clients in various corporate, intellectual property, and tax matters, including reviewing, examining and drafting litigation documents. Janine first joined Procopio in 2021 as a summer intern and later served as a law clerk. Prior to law school, Janine had a robust career as a paralegal. While at the University of San Diego School of Law, she won the CALI Award in Jurisprudence and the USD Enhancement Award, and served as the President of the Black Law Students Association. Janine also holds a BBA in Marketing from Georgia State University.

She serves public agencies and charter schools in general governance, operational, transparency and other matters. Phyillis served as a legal intern for Procopio in 2021 and 2022, bringing experience as a Federal Judicial Intern at the U.S. Bankruptcy Court and as a Congressional Intern at the U.S. House of Representatives. She earned many awards at the Pennsylvania State University Dickinson Law, including the Carter Prize for Environmental Law and the CALI Award of Excellence in Legal Analysis and Writing; was a Dean’s Merit Scholar and a Tom and Anne Miller Public Interest Scholar; and won the Best Oralist Award on the Dickinson Law Environmental Moot Court National Team. Phyillis also holds a BA in Political Science and Government from California State University, Fullerton.

Previously with Latham & Watkins, Mike represents developers, institutional investors, and entrepreneurs in a broad range of commercial real estate transactions, including joint ventures, acquisitions and sales, construction, financing, and leasing of industrial, mixed-use, office and hospitality properties. While in law school, Mike served as President of the UCLA Real Estate Law Association and was named a Peter Bren Distinguished Fellow in Entrepreneurial Real Estate by the UCLA Ziman Center for Real Estate.
