Ninth Circuit Expands Specific Jurisdiction in E-Commerce: What Briskin v. Shopify Means for Online Businesses
The Ninth Circuit sitting en banc has greatly expanded the reach of personal jurisdiction by holding that e-commerce companies can be sued in any state where their platforms interact with users, even without differential targeting and without an in-state physical presence, notes Sean Sullivan. The ruling appears to substantially broaden allegations that may support jurisdiction under a “purposeful direction” theory, particularly when interactive businesses use cookies, geolocation tools, and embedded code to collect consumer data for monetization.

As such, the court hit the brakes on efforts to protect the car under copyright law. The decision draws a sharp distinction between pop culture props and protectable characters. Sean Sullivan breaks down what this means and highlights lessons those wishing to secure intellectual property protection regarding the drafting of filings for protection.

California Senate Bill 1103, named the Commercial Tenant Protection Act (“CTPA”), imposes limits on a landlord’s ability to pass through certain building and common area operating expenses and expands some existing residential tenant protections to certain commercial tenants.
